Terms of Use
Template: replace the bracketed details and have these terms reviewed by a qualified lawyer before relying on them.
These terms apply to the ClockIn service operated by [Operator legal name] (“we”). By creating an account or using a ClockIn kiosk, you agree to them.
Accounts
- The person who creates a company account is its owner and is responsible for the users they add.
- Keep passwords, management PINs and recovery codes private. Tell us promptly if you believe an account was compromised.
- Employees use the kiosk with a PIN issued by their employer and must not share it or punch for someone else.
Employer responsibilities
- You are responsible for complying with employment standards, payroll, tax and privacy laws that apply to you, including overtime, breaks, statutory holidays and record-keeping.
- Jurisdiction presets, calculations and reports are tools to help you. They are not legal, tax or payroll advice. Review results before paying employees.
- If you enable punch photos or location checks, you are responsible for having a lawful reason and for informing employees.
Acceptable use
Do not misuse the service, attempt to access other companies’ data, interfere with its operation, or use it for unlawful purposes.
Your data
Your company owns the data it enters. You can download a backup at any time from Settings. We handle personal information as described in the Privacy Policy.
Availability
We aim to keep ClockIn available but do not guarantee uninterrupted service. Kiosks can store punches while offline and sync them later; keep your own backups for important records.
Limitation of liability
To the extent permitted by law, the service is provided “as is”, and we are not liable for indirect or consequential losses, or for payroll errors that result from incorrect settings or data. [Add any liability cap.]
Ending your use
You may stop using ClockIn at any time. We may suspend accounts that breach these terms. On request we will delete your company’s data, subject to backups expiring on their normal schedule.
Governing law
These terms are governed by the laws of [British Columbia and the federal laws of Canada applicable there].
